2 TERMS AND CONDITONS apply to all orders. Placing an order with THE PICTORIUM LTD is deemed as acceptance of these terms and conditions.
3 COPYRIGHT You must ensure when sending in images to be reproduced that you have sole ownership and copyright, or you have written permission to do so. You must hold the copyright in the image or have permission to use it. We may request you to sign a disclaimer form to confirm this and indemnify us against any breach of copyright. You will be subject to costs or damages to THE PICTORIUM LTD that may occur should the reproduction of any image breaches any other person’s copyright, privacy or rights in any way. THE PICTORIUM LTD reserves the right to refuse any services at our sole discretion (including inappropriate content or images depicting any kind of abuse or discrimination). Rejected orders will have the photo returned to the sender, unless it is deemed offensive, indecent or obscene, when other authorities will be notified. THE PICTORIUM LTD have the right to use your completed image for display or promotional purposes only.
4 ARTWORK Photographs for scanning can be no larger than A4 size. If you require your picture to be cropped this must be marked clearly on the print with masking tape. We cannot accept responsibility for lost or damages files, prints or negatives. We may use your finished image on our website, our partner websites, exhibition stands and in marketing literature and press publicity for marketing purposes. All work must be paid for in advance. Photo and the reproduction is dependent on the quality of the original image so, in some cases, may not be an exact reproduction. We suggest that the file you send is of the best quality your equipment will allow (minimum 500kb). Monitor colours and printers vary considerably therefore colour matching cannot be guaranteed. As a result, completed work is subject to the quality of the image received. Colour variation between your monitor and the final product and/or artistic interpretation do not qualify for quality based refund/replacement. Wherever possible, we will advise you on issues of print quality and image resolution, however we cannot accept liability for any loss of definition or colour. To fit your photo onto the specified canvas size we will often have to crop the original photo. We will do this with the utmost sensitivity to retain the original feel of the image. If there are specific parts of the photo that you would like to keep on the front of the canvas you should let us know in advance Our best efforts are made to reproduce pictures however, due to the bespoke nature of our services; there may be some variation to the size. We have taken all reasonable measures to ensure our prints will be lightfast. However, customers must understand that this cannot be guaranteed either by the manufacturers of the inks we use, or by us. Exposure to excessive heat may cause the timber frame to warp. We are not liable for any warping that may occur as result. We can produce a test print of your image which we can send to you for approval. If you prefer, we can supply a soft proof via e-mail for approval purposes. Should you wish to see further test prints on canvas, each subsequent test print will be charged at €10. For Collage, Scrolls, iTune, Book Collages, Baby Born prints or any other personalised designs, the preview is for viewing purposes only and cannot be amended. Therefore, you should ensure you are completely happy with the image supply before we start work. If you do want to make changes or supply a new photo to us, you will be charged the cost of your chosen style again.
5 RETURNS Our cancellations policy accords to European laws governing distance selling. Due to the bespoke nature of our product, we respectfully ask all of our customers to choose their images carefully as bespoke canvases cannot be returned. Due to the bespoke nature of Personalised Art Photo Prints, you can only cancel your order if we have not yet printed your print. In this case, you will be charged a 50% cancellation fee. If your personalised art order has already been printed, you will be charged in full for your order. Please check your canvas immediately upon receipt. For any questions concerning your order – please call us or email within 5 days of delivery. Any errors on delivery or damaged goods must be notified to THE PICTORIUM LTD within 5 days of receipt. Once the item as left our premises, the delivery address cannot be changed, If you are not in when the item is delivered then it can only be redelivered to that address, If you want to change the address after this then there will be an extra charge, This is down to the courier charging us for redelivery of the item, we do not make any money on redelivery this is the charge passed on from the courier.
6 DELIVERY We aim to despatch your finished canvas prints within 5 working days of order being placed. It is your understanding that it may sometimes take longer than 5 days to despatch your goods. We will do our best to inform you of any such situation but this may not be always possible. To offer best delivery schedule a combination of services is used depending on the size/weight of your order. We try to complete orders as quick as possible but if your order is date dependent (gifts etc.) please allow plenty of time.
7 CHANGES TO THESE TERMS From time to time these terms & conditions may be updated. We reserve the right to do so without any prior notice. Please check at the time or your order to be sure you are up to date with our terms and conditions. It is your responsibility to do so. Our decisions are always final.
8 DATA Your personal data may be retained by us for use in our marketing but only in accordance with data privacy laws. We will not disclose your personal details to any third party.
PRIVACY POLICY We respect and take your privacy very seriously. You may, from time to time, receive information from us about new features, new services and special offers we think you’ll find valuable. However, we NEVER share your personal information with any other third party or company. To remove yourself from our mailing list, simply e-mail us at info@pictorium.ie with the word REMOVE in the subject heading.
